Cat Weight Tracker — Terms of Service

Introduction

Cat Weight Tracker ("the App") is developed and operated by Area43 Labs. By downloading, installing, or using the App, you agree to be bound by these Terms of Service ("Terms").

Cat Weight Tracker helps cat owners track their cat's body weight, daily calorie targets, body condition score (BCS), and food intake.

Please read these Terms carefully before using the App. If you do not agree to these Terms, do not use the App.

Acceptance of Terms

By accessing or using the App, you confirm that you are at least 13 years of age and agree to these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Area43 Labs reserves the right to update these Terms at any time. Continued use of the App after any changes constitutes your acceptance of the revised Terms.

Not Veterinary Advice

Cat Weight Tracker is an informational and tracking tool only. The calorie targets, body condition score guidance, weight trends, and exported vet reports are calculated from general veterinary nutrition formulas and are intended to support — not replace — professional veterinary care.

You should consult a licensed veterinarian for diagnosis, treatment, and any medical decisions regarding your cat's health. Do not rely on the App as a substitute for professional veterinary advice. Area43 Labs is not responsible for any health outcome arising from your reliance on information provided by the App.

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:

• Hack, probe, or attempt to gain unauthorized access to any part of the App or its underlying systems
• Reverse engineer, decompile, or disassemble any part of the App
• Scrape, harvest, or collect data from the App using automated means
• Use the App to transmit spam, malware, or any harmful or unlawful content
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Use the App in any way that violates applicable local, national, or international laws or regulations
• Interfere with or disrupt the integrity or performance of the App or its related services

Area43 Labs reserves the right to suspend or terminate access for any user who violates these rules.

In-App Purchases and Refunds

The App may offer optional in-app purchases (such as one-time purchases or consumable items). All purchases are processed exclusively through the Apple App Store or Google Play Store.

Important:

• Area43 Labs does not collect or store your payment card information — all billing is handled by Apple or Google
• All purchases are final, except where Apple or Google's refund policies apply
• To request a refund, contact Apple Support (Apple devices) or Google Play Support (Android devices) directly — Area43 Labs cannot process refunds on your behalf

Pro / Premium Subscription Terms

The App offers an optional Premium tier that unlocks additional features (such as multi-cat profiles, BCS photo history, and PDF vet report export). Premium is offered as a recurring subscription and as a one-time lifetime purchase, billed through the Apple App Store or Google Play Store.

Auto-renewal: Recurring subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.

Cancellation: You may cancel your subscription at any time through your Apple ID or Google Play account settings. Cancellation takes effect at the end of the current billing period — you will retain access to Premium features until the period ends.

Expiry: When your subscription expires or is cancelled, your access reverts to the free tier. Your data is retained; only Premium features (multi-cat, BCS photo capture and history viewing, PDF export) become unavailable. Existing cats and previously saved photos are not deleted, but new Premium features remain locked unless you re-subscribe or upgrade.

Lifetime purchases: A lifetime purchase is a one-time, non-recurring payment that grants Premium access for as long as the App is supported on your platform. Lifetime purchases are not refunded on a prorated basis if the App is later discontinued.

No prorated refunds: We do not offer prorated refunds for the unused portion of a subscription period. If you cancel mid-period, you retain access until the period ends, but no partial refund is issued.

Intellectual Property

The App, including its design, code, content, logos, and trademarks, is owned by Area43 Labs and is protected by intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the App without our prior written consent.

Your data: You retain full ownership of any data you create or enter into the App (cat profiles, weight and BCS logs, food logs, photos). Because data is stored locally on your device, Area43 Labs does not host or process your content on its own servers. We do not claim ownership of your content.

Disclaimer of Warranties

The App is provided "as is" and "as available" without any warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, Area43 Labs disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Any guarantee of uninterrupted, error-free, or secure operation of the App
• Any guarantee that defects will be corrected, or that the App or its servers are free of viruses or other harmful components
• Any guarantee that calorie targets, BCS guidance, or other health-related calculations are accurate, complete, or appropriate for your cat's individual circumstances

Your use of the App is at your sole risk.

Limitation of Liability

To the maximum extent permitted by applicable law, Area43 Labs and its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the App, even if Area43 Labs has been advised of the possibility of such damages.

This includes, without limitation, loss of data, loss of profits, loss of goodwill, any health outcome for your cat, or any other intangible losses.

In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, Area43 Labs's liability is limited to the greatest extent permitted by law.

Termination

Area43 Labs may suspend or terminate your access to the App at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, Area43 Labs, or third parties.

You may stop using the App at any time. Because all of your data is stored locally on your device, uninstalling the App removes all locally stored data. To raise any concern about your use of the App, contact us at legal@area43labs.com.

Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) shall survive.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.

Changes to These Terms

Area43 Labs may update these Terms from time to time. When we make material changes, we will notify you via an in-app notification or email (if you have provided one). The updated Terms will be effective upon posting.

Continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.
